Terms & Conditions

(1) Shipper agrees that the goods herein described are accepted in apparent good order (except as noted) and in tendering this shipment agrees to the terms and conditions of this contract which is also set forth in Bacarella Trucking Services tariff.
(2) Bacarella Trucking Services will not be liable for the transportation of money, bullion, bonds, jewelry, precious stones, valuable papers or other articles of extraordinary value nor for damage to any article improperly packaged to withstand ordinary handling.
(3) Subject to the classifications and tariffs in effect on the date of the issue of this bill of lading. The value is hereby agreed to be not exceeding $50.00 for any weight for any shipment in excess of 100 pounds, unless a greater value is declared at time of shipment and additional freight paid therefore and the carrier’s liability is limited to such agreed value.
(4) Due to the nature of the business, Bacarella Trucking Services cannot guarantee delivery by a stipulated date or by a stipulated time, nor shall Bacarella Trucking Services be liable for the consequences do delay, misdelivery or the failure to deliver.
(5) Written Notice of Claim for loss, damage, and nondelivery must be reported to Bacarella Trucking Services by Shipper within 15 days after tendering the shipment for carriage. Claims for concealed damage must be reported to Bacarella Trucking Services within 48 hours of deliver. Claims for loss, damage and/or nondelivery must be filed by Shipper in writing with Bacarella Trucking Services within 30 days after notice of loss. (No Claim for loss or damage to a shipment will be entertained until all transportation charges thereon have been paid. The amount of the claim may not be deducted from transportation charges.)
(6) Receipt by the Consignee of the shipment without written notification of damage on the delivery receipt shall be prima facia evidence that the shipment has been delivered in good condition.
(7) C.O.D. services are not available and a C.O.D. shipment sent in error will be delivered as a normal pre-paid or collect shipment.
